The panel is conducting an inquiry separate from the criminal probe the administration is pursuing, and the Pentagon has said sharing some information may compromise the prosecution. Committee Chair Joe Lieberman (I-CT) and Sen. Susan Collins (R-ME), the panel's ranking Republican, served the subpoenas to the Defense and Justice departments. The lawmakers said in a letter to the agencies that they have been formally requesting information for five months. "Our efforts have been met with delay, the production of little that was not already publicly available, and shifting reasons why the departments are withholding the documents and witnesses that we have requested," the senators said. The subpoenas demand information about the shooting by April 26. Lieberman, an independent who caucuses with Democrats, and Collins had warned the administration last week about the subpoenas. They cited documents that had no bearing on the prosecution of the suspected shooter, such as personnel files and performance evaluations. According to the lawmakers, documents such as witness statements have been provided in summarized form to an independent panel that reviewed the shooting and Pentagon security procedures, but not to the committee. Defense Sec. Robert Gates had said in a press conference last Friday, "Anything that does not have any impact on that prosecution, we are more than willing to share. We have no interest in hiding anything, but what's most important is this prosecution and we will cooperate with the Committee in every way, with that single caveat, that whatever we provide doesn't compromise the prosecution." Liberaman, however, responded in a statement, “There are many examples, for allowing Congress to interview FBI agents, even while a criminal prosecution was in progress for which they could be witnesses, so we view that argument as baseless." The White House has refused to comment on the matter. "The Department of Defense is handling this investigation," Press Secretary Robert Gibbs said in a Friday briefing. The shooting at Fort Hood occurred on Nov. 5 at a "readiness center" where troops routinely gather for medical and dental consultations before their deployment. Maj. Nidal Malik Hasan, an Army psychiatrist and practicing Muslim, is believed to have used a handgun and a semiautomatic against fellow soldiers. The tragedy at the nation's largest military base occurred just days before Veterans Day and amid public debate about whether more troops should be sent to fight in the Afghan war, now on its ninth year. Hasan has been charged with 13 counts of first degree murder and 32 counts of attempted murder. His motives are still unclear, but he was due for deployment before the shooting and had sent e-mail messages to Muslim cleric Anwar al-Awlaki while he was a doctor at alter Reed Medical Center. Awlaki is the former imam of the Dar al Hijrah Islamic Center in Virginia, a mosque attended by two 9/11 hijackers. An American citizen, he has been included in the target list of people the CIA is authorized to capture or kill. The FBI has said the e-mail messages were "consistent" with Hasan's work as an Army psychiatrist. Gates last week instructed the Pentagon to immediately implement 26 recommendations made by an independent panel headed by former Army Secretary Togo West and retired Navy Adm. Vernon Clark. The panel gave 79 recommendations to close gaps in personnel policies, mass casualty preparedness and security programs. The Pentagon is still studying the remaining 53 recommendations, some of which require amendments to federal law. Among the changes is the adoption of the eGuardian, an unclassified system used by the FBI to report suspicious activities.. In addition, James Clapper, undersecretary of defense for intelligence, has been ordered to prepare a policy for privately owned weapons in the absence of such rules within the Defense Department. The report from the panel, which will be released in June, said the Pentagont's commitment to the Joint Terrorism Task Force program with the FBI is "inadequate." It also said military policy on banned activities is unclear and does not allow commanders to act with guidance on potential threats to troop discipline and good order.
