Bank Of America Agrees To $137 Million Settlement For State Fraud Cases

D.C., Washington, United States (AHN) - Bank of America agreed Tuesday to a $137.3 million settlement for state fraud cases. The federal government said the bank defrauded schools, hospitals and other state and local organizations through municipal bonds that it raised for localities to pay for public services.
 
 The Securities and Exchange Commission said the bank’s securities group helped rig bids on municipal bond contracts.
 
 The SEC conducted the probe as part of a wide-ranging investigation into the municipal derivatives markets, particularly if investigating Wall Street banks that won investments while they defrauded cities, school districts and nonprofit organizations.
 
 According to the SEC, the process used by BofA was not competitive because bidding agents directly gave the business to the bank. In return,  BofA employees gave the agents kickbacks. The  agents are supposed to set up a competitive bid for the investment dollars.
 
 In addition to current Bank of America executives, eight other bankers including former officials of BofA, UBS and JPMorgan Chase have entered guilty to charges of fraud and conspiracy.
 
 BofA informed the Justice Department in 2007 that there was potential wrongdoing from 1998 to 2003. Because of the bank’s initiative, Washington agreed not to file criminal charges against BofA. However, the criminal immunity is not applicable to BofA employees.
 
 The $137.3 million settlement is broken down into $107.8 million to the organizations as restitution, $25 million to the Internal Revenue Service for abuses on the tax-free status of municipal bonds and $4.5 million to state attorneys general for the cost of investigation.
