ADVERTISEMENT The court overturned its earlier ruling that Time had defamed Suharto in a May 1999 article alleging he had amassed a vast fortune through corruption. "The one trillion rupiah (93 million dollars) of damages is not granted," Supreme Court judge Hatta Ali said. "We determined that the article wasn't against the law. There was no violation of press ethics because the right of reply was given." Suharto sought more than 27 billion dollars in the defamation suit filed against the Asian edition of US-based Time. The court awarded him one trillion rupiah in damages in September, 2007 and ordered the US-based magazine to apologise for the article. In February last year the publication submitted a demand for a review of the Supreme Court ruling, saying it had been based on a "manifest error." The article said a four-month investigation in 11 countries had traced some 15 billion dollars in wealth accumulated by Suharto and his six children. The dictator died aged 86 in January last year, having never been brought to trial for corruption during his 32-year rule. The Time case has been closely watched as a benchmark for press freedom in democratic Indonesia. In one of his last media interviews before he died, Suharto told Gatra magazine in late 2007 that he would give any damages he received to the poor. He also denied that he had stashed a fortune in Switzerland, one of the countries where Time said he had hidden his ill-gotten wealth. "It's not true. If there are any (funds) let them be given to the people. But in fact there are none," he said. Suharto resigned amid mass protests and economic chaos in 1998. Anti-corruption watchdog Transparency International described him in 2004 as the world's most corrupt leader ever, accusing him of stealing 15 to 35 billion dollars in state assets. Suharto's youngest son, Hutomo Mandala Putra, popularly known as Tommy Suharto, was cleared of a 400-million-dollar civil corruption case in February. The government had alleged that Tommy illegally sold off assets from troubled car importer PT Timor to five of his companies at a discount to avoid paying off state loans made to Timor during the 1997 Asian financial crisis. Anti-corruption campaigners said the case proved that President Susilo Bambang Yudhoyono's anti-corruption drive was no match for the ongoing influence of the Suharto clan. Tommy successfully fought off a separate 61-million-dollar civil corruption case against him in February 2008, winning 550,000 dollars in a counter-suit.
