ShareThis April 16, 2010 10:01 a.m. EST Topics: government, politics, government departments, defense, national security, crime, law and justice, prosecution, United States Kris Alingod - AHN News Contributor Washington, DC, United States (AHN) - A former official at the National Security Agency has been charged with leaking classified information to a reporter of a national newspaper that published a series of damaging articles about the agency. A federal grand jury in Maryland returned a 10-count indictment on Thursday against Thomas Drake, who worked at the NSA from 2001 through 2008. Drake, 52, is accused of being the source of articles published between February 2006 and November 2007. He allegedly provided nonclassified and classified material to a reporter using a non-governmental paid e-mail service that allows senders and recipients to conceal their identities. Prosecutors say that a congressional staffer had asked Drake in November 2005 to speak with a reporter, who is unnamed in the indictment but is identified in reports as Siobhan Gorman, who then worked for the Baltimore Sun and is now with the Wall Street Journal. Drake is believed to have contacted the reporter using an alias. He volunteered to provide information about the agency, and instructed the journalist to create a secure e-mail account, according to the FBI. Drake set certain conditions for his disclosure, including keeping his identity secret, attributing information he provided as coming from a "senior intelligence official," and never using him as the single source for information. He also allegedly recommended the reporter to use certain people as sources. The articles written by Gorman focused on several NSA programs, including one called ThinThread that had advanced surveillance tools and built-in privacy protections but was eventually rejected by Bush administration officials due to "bureaucratic infighting." "The privacy protections offered by ThinThread were also abandoned in the post-Sept. 11 push by the president for a faster response to terrorism," according to the 2006 Sun article, titled "NSA Killed System That Sifted Phone Data Legally." Some reports attributed the indictment against Drake to New York Times stories about the NSA's warrantless domestic wiretapping program. The Times itself, however, said that while it was investigated by the Bush administration for its stories, no charges have been filed in that case. Last month, a federal judge ruled that the NSA's warrantless anti-terrorist surveillance program under the Bush administration was illegal. The indictment against Drake charges him with five counts of willfully retaining documents that relate to the national defense, one count of obstruction of justice for shredding documents and deleting files in his home computer. He was also charged with four counts of making false statements to FBI agents investigating the leak. "Our national security demands that the sort of conduct alleged here—violating the government’s trust by illegally retaining and disclosing classified information—be prosecuted and prosecuted vigorously, Assistant Attorney General Lanny Breuer said in a statement.
