Arnold Schwarzenegger has vetoed legislation stopping landlords from requiring prospective tenants to have the claws of their cats and vocal cords of their dogs removed, procedures the bill's supporters said harmed animals and pose risks to pet owners. Assembly Bill 2743 would have amended the state civil code by making it illegal for landlords to include declawing or debarking in rental agreements. The measure passed with both Democratic and Republican support in the legislature and was endorsed by the California Apartment Association. The governor, however, cited "legitimate medical needs" of a pet owner as the reason for his veto despite his support for the larger cause of the bill. "I cannot sign a measure that contains findings and declarations by the Legislature that are unsupported by science," Schwarzenegger said in a statement. "Regrettably, this bill goes too far in attempting to deal with inappropriate demands by landlords." The California Veterinary Medical Association had asked the governor to veto the legislation, questioning the connection between declawing and public safety, and warning the bill would lead to legislation "limit[ing] the veterinarian-client-patient relationship." The CVMA believes declawing is necessary for medical reasons such as chronic infections or tumors in cats, or if the pet owners are elderly or disabled. The group says behavioral issues such as "using claws in a destructive manner" are among the main causes of abandonment of cats. The legislation authored by state Assemblyman Pedro Nava does not prohibit veterinarians from debarking or declawing pets. It warns of behavioral changes in declawed cats such as increased aggression and litter box avoidance, and bites from a debarked dog that could pose a danger to law enforcement officers entering a home. "The permanence of these surgical procedures contrasts with the temporary nature of the occupancy of real property owned by another, which generally lasts only for a fixed term," the bill said. Eight local governments in California have recently banned declawing, including Beverly Hills, Culver City, Los Angeles, San Francisco and Santa Monica. According to a non-profit, In Defense of Animals, increased aggression is a typical result of the procedure since a cat's primary means of defense has been taken away. The group urges pet owners to consider a number of alternatives to declawing, such as training pets and using scratching posts, sprays and clear sticky strips applied to furniture. The California Apartment Association also recommends that landlords use security deposits to keep their property undamaged. Debarking, which involves removing tissue from a dog's vocal cords, is outlawed in the United Kingdom. Animal advocates consider the procedure inhumane, arguing that dogs lose their ability to communicate.
