Khadr, held since age 15 on charges of killing a US soldier in Afghanistan, is the last Westerner in the prison at the US Naval base at Guantanamo Bay. While there has been a flurry of activity in the past month inching toward a possible plea agreement, the detainee, now aged 24, faces a resumption of his trial before a military tribunal Monday with no deal in hand. "There is a trial tomorrow and there is no deal in place at this particular moment," Khadr's lawyer Dennis Edney said. "Omar is nervous and tense. He is confused," Edney told reporters here. "He tries to understand why US President (Barack) Obama has received the Nobel Peace Prize... and yet he's still here when hundreds and hundreds of detainees have been released." The trial, delayed in August following the collapse of one of Khadr's lawyers, had been postponed again last week until Monday so that the two sides could discuss a possible agreement. The top diplomats of the United States and Canada held discussions but it was not immediately clear if they were talking about the fate of Khadr. US Secretary of State Hillary Clinton and Canadian Foreign Minister Lawrence Cannon, who was on a trip to Beijing, spoke by telephone, representatives for the two officials said. Khadr, the son of an Al-Qaeda official killed in 2003, was just 15 when he was arrested for allegedly throwing a hand grenade that killed a US sergeant during a 2002 attack in Afghanistan. US prosecutors have painted Khadr as a committed warrior intent on killing Americans; his defense insists he was a frightened boy forced into battle by his father. If found guilty Khadr faces up to life in prison. Human rights groups say a secret deal being discussed could see Khadr serve just eight years in prison, much of that in Canada, although lawyers and officials have not commented on details of negotiations. Canadian Prime Minister Stephen Harper's conservative government has refused to seek Khadr's repatriation, saying that US proceedings should run their course, despite criticism from some opposition lawmakers. "The Canadian government has never spoken with us" about the case, defense attorney Edney said. "I'll be meeting him in a few hours and as always I'll meet him chained to the floor," Edney said, referring to measures at Guantanamo's medium-security Camp IV, where Khadr is held. "Our conversation will be monitored and any material I bring in will be scrutinized."
