Amina Bokhary, whose uncle Kemal Bokhary is a judge of the city's highest court, was given probation Monday for slapping a police constable who tried to stop her leaving the scene of her car's collision with a coach in January. She was also fined 8,000 Hong Kong dollars (1,000 US) for careless driving and refusing to take a breath test. Magistrate Anthony Yuen said Monday he considered her "good background, well-off family (and) outstanding academic achievement" as mitigating factors. He also noted she suffered from bipolar disorder. Yuen's judgment attracted widespread criticism from the public and police, who said the 34-year-old should face harsher punishment. But following a review of his own ruling at the government's request, Yuen said Friday it would not change. Hours later, the Department of Justice said it would appeal the sentence. "Having carefully considered in detail the reasons of the magistrate for dismissing the prosecution's application for review of sentence, the Department of Justice will apply to the Court of Appeal for leave to review the sentences," the department said in a statement. The case has sparked a public outcry and accusations that Hong Kong's justice system favours the rich. "Cases such as this show that the law in Hong Kong often only protects the interest of the wealthy upper class," Fermi Wong, a social worker for ethnic minorities, told AFP. "Had she been a poor Pakistani or Indian teenager in Hong Kong, a jail term would be inevitable. And I have many examples to show you." Police unions submitted a joint letter to police force management describing the sentence as "manifestly insufficient," while lawyers and rights groups have urged the government to review the law and provide a sentencing guideline. The case has also sparked discussion in Internet chat rooms over the fairness of the magistrate's decision. Amina Bokhary was booed and chased by a crowd of photographers and onlookers when she left the court.
