Venezuela's National Assembly banned on Monday Internet content that promotes social unrest, challenges authority or condones crime. The measures also expanded restrictions on radio, television and print media output. The law was pushed through by Chavez's ruling Socialist Party just weeks before a new assembly -- in which pro-government entities lose their supermajority -- starts sitting on January 5. The new measures, covering content from the Internet and electronic subscription services, make webpage managers "responsible for the information and content" published on their websites. They aim to crack down on media content that "makes an apology of crime," "promotes unrest in the population" or "challenges legally established authorities." The legislation increases fines for media violations to "10 percent of the previous year's gross income," in addition to "72 hours of continuous suspension of services." For Gloria Cuenca, a communications expert at the Universidad Central de Venezuela, the measures encourage independent media "to self-censor themselves out of fear, and threatens the right of users to freely use the Internet." There is plenty of fear "that we are heading to a situation of Internet content blocking like in China or Cuba," Cuenca said. Public Space, a pro-free speech NGO, said the laws "seriously limit the sharing of ideas, debate, and the pluralism so necessary in a democratic society," and the sanctions "fuel inhibition and self-censorship." Supporters however say the purpose of the laws are to regulate Internet content, not access. "We have to protect the people from violence, pornography and anonymous attacks" on the Internet, Chavez said recently. The president has a tense relationship with privately-owned news outlets, but the government also controls four television networks, five radio networks and a national newspaper, and can count on a broad network of pro-government community media to get its views across. Manuel Villalba, a pro-government legislator, said there will be no Internet censorship. "Our goal is for every person to be responsible for the opinions they air on a radio or television program," he told AFP. But others warned that labeling the broadcast media a public service, as the new measures do, is of deep concern. With this declaration "there is a latent threat to the media. The state fully reserves the right of administration, oversight and tenure (license granting) of radio and television stations," said Secretary General of the National Syndicate of Press Workers Marco Ruiz. Broadcast licenses "now become a temporary loan" for station owners, "with a permanent threat of expropriation or permit revocation depending on the political tilt of the information being broadcast," he said. In 2007, the privately-owned RCTV network, which fiercely criticized the Chavez administration, was forced off the air when its license was a not renewed. And in 2009, 34 radio stations were forced off the air for failing to meet government regulations. The leftist Chavez administration is currently trying to shut down Globovision TV for its strong anti-Chavez stance. Globovision boss Guillermo Zuloaga, facing criminal charges, had fled to the United States where he is seeking political asylum. The new legislation also makes it easier for the state to purchase media shares. For example, when a radio or television shareholder dies, the government has the priority in buying the person's shares. The new laws "no doubt strengthens persecution and harassment against the media, and form part of a government obsession to criminalize, punish and censor journalistic work," Ruiz said.
