PITTSBURGH – ACORN is no longer suing a county prosecutor as it seeks to strike down a state law used to prosecute voter-registration workers who allegedly employed a quota system in the Pittsburgh area.

The voter advocacy group filed the settlement with Allegheny County District Attorney Stephen A. Zappala (ZAH'-pah-lah) Jr. on Tuesday. ACORN has claimed the law prohibiting pay based on the number of voter registrations in unconstitutional.

In exchange, Zappala agreed not to prosecute ACORN if the group pays its workers by the hour, not by registration numbers.

The lawsuit continues against state Attorney General Tom Corbett. A spokesman for Zappala says it didn't make sense for two agencies to defend the law's constitutionality.

The settlement does not affect criminal cases against several former ACORN employees accused of fraud.
