Former French prime minister Dominique de Villepin speaks to the press as he leaves court in Paris. French prosecutors will appeal the court decision to acquit Villepin of plotting to smear Nicolas Sarkozy to torpedo his presidential bid, state prosecutor Jean-Claude Marin said Friday.
PARIS (AFP) - – The French government on Sunday hit back at claims that it had pulled strings to ensure a second trial for President Nicolas Sarkozy's long-time rival Dominique de Villepin.
Villepin was acquitted last week on charges of conspiring to slander Sarkozy in 2004 and wreck his presidential bid, but the chief prosecutor decided to appeal the decision.
Justice Minister Michele Alliot-Marie said the prosecutor did not receive "instructions or incitement" from anyone when he decided to lodge the appeal.
"I'm not in the habit of hiding," Alliot-Marin told French radio. "If I had instructions to give, it would have been done in writing and substantiated," she said.
Villepin, the 56-year-old ex-prime minister and foreign minister, had accused Sarkozy and his government of being behind the move by state prosecutor Jean-Claude Marin.
But the justice minister was adamant: "Jean-Claude Marin did not receive any instructions or incitement whatsoever before he took his decision."
The government has rejected claims that the second trial for Villepin was politically-motived and even first lady Carla Bruni-Sarkozy has come to the defence of her husband.
The ex-model told French radio RTL on Saturday: "I believe fundamentally in the independence of the judiciary, I am stunned by this sort of allegation."
Villepin said the decision to appeal was taken during a meeting at the Elysee palace on Thursday evening, but the president's office has denied the allegations.
Former justice minister Robert Badinter added fuel to the controversy when he said that "in the case of Mr de Villepin, it is obvious that the decision to appeal was not taken without the approval -- or perhaps even at the behest of -- the justice ministry and the Elysee."
Following a month-long trial last year, Villepin was acquitted on Thursday of taking part in a plot to slander Sarkozy in 2004, when the two men from the right were angling to succeed president Jacques Chirac.
Villepin and four other defendants were accused of using falsified bank accounts to discredit Sarkozy ahead of his party's nomination for the 2007 presidential vote, which he won.
Sarkozy's name was on the bogus list of hundreds of account holders at the Clearstream financial clearing house who allegedly took bribes from the sale of French warships to Taiwan.
Dubbed the Clearstream affair, the scandal made front page news across France when it broke in 2005 and Sarkozy long suspected that Villepin was behind an attempt to sabotage his presidential bid.
The acquittal was an outright victory for Villepin and a blow to Sarkozy who had reportedly vowed to hang those responsible for the scandal by a "butcher's hook."
Three other men were convicted in the case, dubbed France's trial of the decade.
The decision was seen as bolstering Villepin's chances of a comeback as he sets his sights on the 2012 presidential vote.
