Credit: Reuters/Phil McCarten By Alex Dobuzinskis LOS ANGELES | Sat Apr 23, 2011 2:09am EDT LOS ANGELES (Reuters) - Lindsay Lohan was briefly jailed again on Friday after a rollercoaster day in which a judge downgraded her jewelry theft charge, but sentenced the actress to four months behind bars for violating her probation. Looking confused and distressed, Lohan -- who was locked up for two weeks last summer -- was taken immediately to jail from court after a day-long preliminary hearing on charges that she stole a $2,500 gold necklace from a store in January. The "Mean Girls" actress was ordered to stand trial on June 3 but the jewelry charge was reduced to a misdemeanor from a more serious felony, and will cut to one year her maximum time behind bars if eventually convicted. Los Angeles judge Stephanie Sautner, however, felt the evidence on Friday suggested Lohan intended to steal the jewelry. She therefore ruled Lohan had violated her probation for a 2007 drunk driving and cocaine possession incident, and sentenced her to 120 days jail and 480 hours community service in a morgue and women's prison. Lohan's lawyer filed an immediate appeal and Lohan's camp scrambled to post $75,000 bail and secure her release from custody pending an appeal hearing. She was released late on Friday after about five hours, according to the Los Angeles County Sheriff's Department website. Lohan, 24, has strenuously denied that she deliberately walked out of a Los Angeles store wearing a necklace without paying. Her lawyer on Friday argued that she was distracted and absent-minded when she left with the item around her neck. Lohan's assistant returned it to police after news leaked that a search warrant was to be served on Lohan's house. "There is a lot of hoopla surrounding Ms. Lohan, but at the end of the day, relatively speaking, this is not particularly serious as grand thefts go," Lohan's lawyer Shawn Holley said. "This is a necklace ... that was returned 10 days later." But judge Sautner did not buy the defense argument. "I see the intent here and I see the level of brazenness with 'let me see what I can get away with'," Sautner said. "She thumbs her nose at the court, she walks into court with FU on her fingernails," Sautner said, referring to an appearance last year by Lohan in another case. Lohan has been in and out of rehab, jail and courtrooms multiple times since 2007. Once considered among the most promising young actresses in Hollywood, Lohan's movie career has come to a virtual halt. Earlier this week she secured a role in an upcoming film about New York mobster John Gotti. But it was not clear how she would fit filming around possible prolonged spells locked up. You are still presumed innocent until proven guilty at trial in this great country. The judges opinion has no value prior to trial of the FACTS. Look at the true facts: Lindsay was seen on the store video wearing the necklace in plain sight of the owner. She spoke at length to the owner and clerk. They watched her leave wearing the necklace in plain view. No complaints. After all, why would a wealthy actress need or want to steal anything…especially being under probation. Three long weeks later they file these obviously false charges. That jives with Lindsay saying it was loaned to her (but her staff erred and returned it late thinking there would be no problem since they had a good relationship…good enough to let her borrow it in the first place) which is a standard practice in the business so the store gets free publicity. Anyone in the business can plainly see that not only did they lend this to her, along with earrings a few weeks prior…that she returned without incident, but that the necklace is worth about $500, not a penny more. Then the owner sells the video tape for a reported $40,000 for a quick buck tainting the jury since there is conveniently no audio to prove what the deal was and says they want to auction the necklace to make even more money off this travesty. The prosecutor should have gone to court to stop this but instead leaked edited portions of the tape to further taint the true facts. It should have been the end of the case right there. But the prosecutor and judge want to milk fame from this young lady since they can’t get ahead on their own…obviously because they have no clue about the laws. To be in violation of parole she would have needed to be CONVICTED, not assumed to be guilty by this low life publicity-hungry judge. Sending her to jail for a probation violation before she is convicted threatens all of our rights. When (not if), she is found not guilty, how will this judge compensate her for the wrongful time of unjust punishment? The judge knows she just signed two major movie deals worth millions and now she will lose them and her much needed income. Let’s not forget that she kindly supports her whole family and employs many, many people that need jobs in today’s market. Lindsay’s law team needs to bring a malicious prosecution case and official misconduct complaint against the judge and prosecutor as they clearly have exceeded their authority and have knowingly broke the law. Then go after the store owner for fraud, unjust enrichment (using Lindsay’s image on the video without permission or compensation), defamation of character, etc. and get her side of the true story out there. And get a lip reader to testify in court what they were saying on the tape. This country is in deep trouble. Next time you get a speeding ticket, how will you feel when they lock you up for 3 months because the judge has a bad opinion of you despite not going to trial first? Shameful Soviet style tactics. Time to purge these prosecutors and judges who do this everyday. Jail them for 120 days and see if they like their made-up laws. And, make a law that prevents them from ever commenting to the press, then they will have no motive to enrich themselves at our expense. This struggling young lady is trying hard to turn her life around and make good. The judge and prosecutor need to do the same for themselves. Get a life. This is America, still a place where Rule of Law matters.And Lindsay, move out of that state. Go down to St. John, USVI and enjoy your life without these leaches trying to constantly attack you to make names for themselves.
