Deputy District Attorney Jason P. Lustig wrote in a decision Tuesday that evidence indicates the kick by El Monte Officer George Fierro was more likely an attempt to stun or distract gang member Richard Rodriguez than an act of anger or vindictiveness. Rodriguez was lying face-down on the ground during the May 13 incident, which was broadcast by a TV news helicopter. Prosecutors also will not charge another officer, James Singleterry, who struck Rodriguez with a flashlight. Rodriguez has filed a claim for $5 million in damages from the city. ___ Information from: San Gabriel Valley Tribune Recommend Send IM Story Print Related Articles Appeals court limits police use of Tasers AP - 1 hour 37 minutes ago Russia may send spacecraft to knock away asteroid AP - 1 hour 40 minutes ago Murder victims found hanging from Mexico overpass AP - 1 hour 42 minutes ago Released prisoners in Ill. accused of new crimes AP - 2 hours 22 minutes ago Iran opposition leaders told to repent or else AFP - 2 hours 26 minutes ago News Search Top Stories Yeltsin's widow urged husband not to resign: report England's Strauss hails 'emphatic' win over S.Africa French public debt hits record Eurozone lending declines, hope lies in households Sarkozy scrambles to salvage carbon tax More Top Stories » ADVERTISEMENT Most Popular Most Viewed Most Recommended Van der Sar granted leave after wife collapses Picasso painted little guitar found in Italian shoe box: reports Lockheed to sell 24 F-16 fighter jets to Egypt China executes British national despite pleas Obama: 'We will not rest' until air terror plotters caught More Most Viewed » Tiger's wife Elin seeking divorce: reports British priest defends urging people to shoplift Century-old butter found in Scott's Antarctic hut Brazilian confesses to sticking needles into two-year-old Plastics component affects intestine: study More Most Recommended » Elsewhere on Yahoo!
