ShareThis June 30, 2010 3:17 p.m. EST Topics: racism, politics, local authority, trials, social issue, crime, law and justice, litigation, United States Kris Alingod - AHN News Contributor Los Angeles, CA, United States (AHN) - Closing arguments in the murder trial of Johannes Mehserle, the former Bay Area Rapid Transit police officer who fatally shot a unarmed black passenger last year, are set for Thursday. Officials are preparing for riots following the verdict in a case that has ignited racial tensions in Oakland. The last day of testimony had an expert discussing the weight of Mehserle's Taser and his gun at the time of the shooting, a Sig Sauer. The Taser weighs 359 grams while the pistol is 1,140 grams, a difference of 2 1/2 pounds. Mehserle, who is white, has pleaded not guilty to murder charges. He fatally shot Oscar Grant on the train platform of Fruitvale station on Jan. 1, 2009, but claims to have mistakenly used his gun instead of his Taser while trying to handcuff the victim. A friend of the defendant, BART police officer Terry Foreman, said on the stand Tuesday that Mehserle never told him the shooting was an accident and that he was reaching for his Taser. Mehserle broke down crying one time, Foreman testified, and said he thought Grant was going for a gun. Grant, 22, was on his way home when he and several other riders were ordered off a train by transit police who were trying to break up a fight among some passengers. His death was recorded by other passengers taking video of the commotion using their cell phones. The videos show him kneeling with his arms raised along with other riders on the platform, being forced face down onto the ground by two police officers, and then being shot. Mehserle defended himself on the stand last week, telling the jury that he was focused on Grant's right hand, which he said was going into a pants pocket. When asked under cross examination why he moved to use his Taser when other officers holding down the victim could also be stunned, he replied that he was reacting quickly over concerns that Grant had a gun. Mehserle was one of several responding officers at the scene but is the only one who has been charged. Another officer, Tony Pirone, has been on paid leave since the shooting. He allegedly verbally abused and beat Grant before Mehserle arrived at the scene. The former transit officer's testimony appears to contradict footage of the shooting, which shows the victim being restrained by two other cops. Pirone, who had one knee on the victim's neck, was also restraining Grant's right arm, the same one Mehserle said was retrieving something from a pocket. But an expert called to the stand by Mehserle's defense attorney on Tuesday testified that officers sometimes suffer from tunnel vision and react to stressful situations by reflex, in this case drawing a gun. Mehserle had previously testified that he had trained only briefly using his Taser. Mehserle resigned six days after Grant's death, the same day he was scheduled to answer questions for the first time about the shooting. His testimony last week was the first time he spoke public about the incident, which caused massive riots in Oakland. Oakland police are now preparing for racially-charged demonstrations following the verdict, which could come as early as Friday. Officers underwent training two weeks ago "in anticipation of... possible civil unrest." The trial echoes another one that ended in violence when in 1992 four white police officers who were captured on video beating a black man, Rodney King, were all acquitted.
