MADRID (AFP) - – Spain's high-profile judge Baltasar Garzon Saturday filed an appeal against another judge's decision to indict him for abuse of power for launching a probe into Franco-era atrocities. Garzon's lawyer argued that the decision by Supreme Court investigating judge Luciano Varela is "contrary to law and constitutes a serious threat to judicial independence as guaranteed" under the Spanish constitution. Varela on Wednesday alleged Garzon ignored a 1977 amnesty law when he launched a probe into atrocities committed during the 1936-39 civil war and the subsequent dictatorship of General Francisco Franco. The ruling means Garzon, best known outside of Spain for trying to extradite Chilean dictator Augusto Pinochet from Britain, could stand trial for abuse of power. Varela was acting on a complaint by several groups, including the far-right Manos Limpias (Clean Hands) and the Falange, a version of the party that provided the ideological basis for Franco's rule, which lasted until his death in 1975. "Certain organisations and marginalised factions" brought the case against Garzon for "ideologicial motives," his lawyer, Gonzalo Martinez-Fresneda, said in the appeal, filed before the Criminal Division of the Supreme Court. Garzon launched the probe in October 2008, arguing that the repression and systematic extermination of political opponents during the Franco era amounted to crimes against humanity and that the amnesty law was not valid in this case. But several months later he transferred the case to provincial courts after state prosecutors questioned his jurisdiction. More than 200 human rights groups and jurists from around the world have signed a letter in support of Garzon that was sent to Spanish judicial authorities. Garzon made world headlines in October 1998 when he ordered the arrest of Pinochet in London, under the principle of "universal jurisdiction" which held that heinous crimes like torture or terrorism can be tried in Spain even if they had no link to the country. He also indicted Osama bin Laden in 2003 for the September 11, 2001 attacks in the United States and looked into the deaths of Spaniards in Argentina during the military regime of 1976-83. Garzon is the target of two other investigations -- one into payments he received for speaking at conferences in the United States sponsored by Spanish bank Santander and other into his alleged bias in a probe he launched into a corruption scandal rocking the conservative opposition Popular Party.
