China's Chint accuses French rival of seeking to block its expansion
AFP - Friday, December 19
MADRID (AFP) - - Chinese low-voltage electrical equipment maker Chint on Thursday accused its French rival Schneider Electric of launching a wave of lawsuits for copyright infringement against it solely to try to block it from entering the French market.
"Schneider's goal is to prevent Chint from entering France, it has nothing to do with patents," Chint vice-president Xu Zhiwu told journalists during a visit to Madrid.
Schneider Electric, a global leader in the electric equipment market, and Chint, which is expanding, have been locked in a legal dispute for over a decade.
Since 1994 Schneider has launched a total of 20 lawsuits in Europe against Chint, accusing the Chinese firm of selling products based on technology patented by the French company which have all been dismissed, said Xu.
Chint estimates that the lawsuits filed against it in France alone have cost the company over 100 million euros (140 million dollars).
For its part, Chint in 2006 filed a lawsuit in a Chinese court accusing Schneider Electric of infringing the patents on its technology.
The following year a court in Wenzhou in eastern China found Schneider Electric to be guilty of violating the patents of five models of Chint equipment and it ordered the French firm to pay its rival 330 million yuan (34 million euros/48 million dollars) in compensation.
The amount of compensation was believed at the time to be the highest in China in intellectual property rights case. Schneider Electric has appealed.
Before the court issued its ruling, the director of China operations for Scheider Electric, Guy Dufraisse, warned that if Chint's lawsuit was successful "the entire system of intellectual property protection in China would be compromised".
Schneider Electric says it has been using the technology Chint patented in 1999 since at least 1990.
The French firm has twice proposed to become Chint's majority shareholder but the Chinese firm refused the offer both times, said Xu.
Schneider Electric followed up the failure of the talks with its judicial offensive, he added.
"We want Schneider to sincerely take its place at the negotiating table," said Xu, adding that the precondition for any talks with Schneider Electric is that the Chint brand not disappear and that its management keep their jobs.
