Two of four newly appointed Senior Counsel are from AG’s Chambers

SINGAPORE: This year’s opening of the new legal year saw a first for the Attorney—General’s (AG) Chambers with the appointment of two of its veteran prosecutors as Senior Counsel — Singapore’s equivalent of the Queen’s Counsel in London.
In all, four new Senior Counsel were named on Saturday. They are Jeffrey Chan and David Chong from the AG’s Chambers, Francis Xavier from Rajah & Tann and Ang Cheng Hock from Allen & Gledhill.
At the opening ceremony on Saturday, Chief Justice Chan Sek Keong said Singapore has not been spared the effects of the global recession and the country’s courts can expect an increase in cases being filed.
He added that he expects both the Bar and the legal service to play their part in assisting the courts to manage the caseload in a timely manner.
Senior Counsel Jeffrey Chan said: "The rule must be to advise their clients properly, to make sure the clients understand what the issues are and not use the courts to get what they want to get. They should go to court only if they have clear merit in their cases and that’s a very important role of the lawyer."
Senior Counsel Ang Cheng Hock said: "In terms of corporate mergers and acquisitions, there will be a dip, so it’s a question of law firms trying to redeploy some of their staff and perhaps do other kinds of work like insolvency, with the economy in 2009 and 2010 going bad."
Disallowing lawyers from holding clients’ monies in conveyancing matters has been another issue that is being studied recently, following a spate of cases involving some lawyers absconding with these monies.
CJ Chan said one solution explored was imposing a special levy on all lawyers to make good the losses to the clients, but that will penalise the majority.
"So long as there is a risk of somebody out there losing their money, we obviously have to do everything within our powers to avoid that... I’m glad to say we are moving towards a system where there is no opportunity for that (to) happen again and that is surely healthy for everybody," said Senior Counsel Francis Xavier.
As Senior Counsel are viewed as role models for younger lawyers to emulate, newly appointed Senior Counsel David Chong said: "I hope it will attract young lawyers to join the legal service knowing that there is recognition that the profession can bestow on them to excel in litigation."
The Senior Counsel scheme started in 1997 and there are now 53 of them in Singapore.
