Ivan Henry, now 64, spent 27 in prison for sexual assault charges in Vancouver he was accused of in the 1980s. Henry’s 27 years incarceration hold the record in Canada for time a prisoner had served for crimes not committed. Henry was convicted in 1983 of three counts of rape, two counts of attempted rape and five counts of indecent attacks on eight different women from May 1981 to June 1982. Henry’s conviction was based on eyewitness testimonies and voice identification evidence. The court of appeal reopened Henry’s case in 2009 after the court discovered the prosecution did not disclose 28 oral and written victims’ statements to police. The prosecution also withheld forensic and police reports that disclosed that biological materials that could have undergone testing and may yield a different result. The court pointed out the legal errors and that the evidence on hand failed to prove Henry was the man behind the crimes which led to the acquittal, said Justice Richard Low, who wrote the decision. Henry tried to file 50 applications over the 27 years to reopen his case. His wife and mother died during Henry’s incarceration, and he now has three grandchildren from his two daughters. He plans to take a vacation with them. Henry’s lawyer said his client is considering seeking financial compensation for the 27 years prison term.
