(AHN) - The Senate Agriculture Committee has set Feb. 25 as the date for the nomination hearing of former Treasury undersecretary Gary Gensler as chair of the Commodity Futures Trading Commission (CFTC). Gensler was nominated in December by President Barack Obama along with veteran Wall Street regulator Mary Schapiro as chair of the Securities and Exchange Commission (SEC). He was part of the Obama transition team and previously served in the Treasury Department as undersecretary for domestic finance from 1999 to 2001 and as assistant secretary from 1997 to 1999. The CFTC is the main regulator of commodities trading and has jurisdiction over $5 trillion in trades. Sen. Tom Harkin (D-IA), chair of the Agriculture panel and the author of the Derivatives Trading Integrity Act, met with Gensler on Jan. 22 about the former Treasury official's work in a 2000 deregulation bill. Harkin had said in a statement after the meeting that they had a "productive" discussion but also expressed concerns. "We were able to get a better sense of one another's views on the necessity of strong regulation of financial markets for the good of the public and economy. President Obama has made strong statements on the topic, about which I am hopeful. Yet I remain concerned about the deregulatory orientation in this nominee's past. These and other issues will be explored during Mr. Gensler's nomination hearing," the senator had said. Obama had said in announcing the nomination of Gensler that he plans to begin protecting investors and crack down on fraud and manipulation. During the campaign, he had proposed to end excessive speculation in the energy markets in order to curb rising costs of oil by closing the "Enron Loophole." The "Enron loophole" refers to a provision in the Commodity Futures Modernization Act signed into law by former President Bill Clinton. The provision was inserted into the law, according to Obama, "at the behest of Enron lobbyists to exempt some energy traders from the regulations and public protections applicable to exchange-traded commodities.
