Conservatives and supporters of the ban had sought to keep the trial, which begins on Monday, private, citing intimidation and harassment of witnesses. Chief Judge Vaughn Walker and the U.S. Court of Appeals for the 9th Circuit ruled on Wednesday against airing the proceedings live, but allowed footage of the trial to be shown hours later on YouTube. According to the American Foundation for Equal Rights, the trial may be streamed live to 9th Circuit courthouses in Pasadena, San Francisco, Portland and Seattle. Walker's decision needs to be approved by the 9th Circuit. It came amid intense efforts by both sides on the gay marriage debate about broadcasting the trial. The Courage Campaign had been gathering signatures for a petition to televise the proceedings. "This case presents issues that are very important to the public, and will affect millions of people. However, only a tiny fraction will ever be able to watch the trial in person," the petition said. But Ron Prentice, executive director of Protectmarriage.com, has warned, "Those who are put on the stand or are seen in the courtroom may very well be recognized and further intimidation or harassment may continue." Two gay couples filed a lawsuit last May challenging the constitutionality of Proposition 8. Their lawyers, former Bush administration Solicitor General Theodore Olson and David Boies, who represented former Vice President Al Gore in the U.S. Supreme Court case that decided the 2000 presidential race, argue that the ban violates the 14th Amendment. At the time, the American Civil Rights Union (ACLU), Lambda Legal, National Center for Lesbian Rights and other liberal groups had warned against "ill-timed, premature" lawsuits based on the federal Constitution. The California Supreme Court on May 26 rejected by a 6-1 vote a constitutional challenged to Proposition 8, an initiative banning same-sex marriages in the state. But the court also unanimously declared the 18,000 gay marriages conducted in 2008 legal. Proposition 8 was passed on Nov. 4, 2008 overturning a California Supreme Court ruling in June the same year that gay couples had a constitutional right to be married, and amid broad opposition from civil rights and gay groups as well as officials including Gov. Arnold Schwarzenegger and state Attorney General Jerry Brown. A total of five states now allow same-sex marriages, with Maine having overturned its law in a November referendum. Vermont was the first state to legalize same-sex marriages without an order from the court. Massachusetts, Connecticut, and Iowa all allowed such marriages only after bitter court battles. The one in Iowa ended April 3 last year, when the state supreme court upheld a lower court decision ruling the state's ban on gay marriages unconstitutional. The District of Columbia in December passed its own bill, which takes effect after a required 30-day review by Congress. In addition, New Hampshire's legislation took effect on Friday, the first day of the new year. But LGBT advocacy groups have suffered setbacks in recent weeks. Apart from the repeal in the Pine Tree State, proponents in the New Jersey Senate in December put off a final vote on a same-sex measure because of the lack of votes to pass it.
