Massachusetts filed the suit arguing that the Defense of Marriage Act, which was passed in 1996 and provides the federal definition of marriage as the legal union between a man and a woman, denies gay couples rights and benefits. A group of Massachusetts made the first concerted legal challenge against DOMA in March. State Attorney General Martha Coakley at the time made clear her support for the civil lawsuit filed by Gay & Lesbian Advocates & Defenders (GLAD) on behalf of the plaintiffs. "DOMA is a law that codifies discrimination on the basis of sexual orientation," Coakley had said. "Because of this law, individuals in same-sex marriages often pay more in federal income taxes, are not eligible for surviving spouse benefits from the Social Security Administration and, if they are employed by the federal government, cannot obtain healthcare coverage for their spouses." The Obama administration has repeatedly said it will not renege on a campaign pledge to repeal the "discriminatory" law, but that it is currently not authorized under federal law to do so. It faced a firestorm of criticisms from the LGBT community last month, when it filed a legal brief in response to a lawsuit filed by a gay couple, Arthur Smelt and Christopher Hammer, who married in California and are challenging the constitutionality of DOMA. A few weeks after the filing, the administration moved to extend federal benefits to same-sex partners of government employees.
