Mexico is demanding a U.S. government investigation. The incident also is adding fuel to Latin American calls for Congress to reform immigration laws. The beating occurred while Anastasio Hernandez Rojas, 32, was being expelled from the United States at the San Ysidro-Tijuana border checkpoint. Border Patrol agents say he forcibly resisted. According to the Mexican government, Rojas was beaten by at least 20 Border Patrol agents, who also shocked him with electrical stun guns. He was admitted to Scripps Memorial Hospital Chula Vista. While hospitalized, he suffered respiratory failure and was disconnected from life support Monday. Rojas, a resident of San Diego County for nearly 20 years, left five children. He worked as a pool cleaner, although he never acquired American citizenship. All of his children are American citizens. The Mexican government said in a statement that it was offering the Rojas family legal advice “to define the legal avenues that will lead to a full clarification of the causes of this tragic loss and figure out, where appropriate, the responsibilities established by law.” The statement also said the Mexican government sought a “thorough investigation of these events by the U.S. authorities with prompt follow-up on how it is developing.” Local news reports say Rojas’ brother, Martin Hernandez Rojas, said he was beaten initially by police while he was handcuffed and on the floor. When Anastasio Hernandez Rojas yelled at the Border Patrol agents to stop beating his brother, they turned on him and beat him severely, Martin told news agencies. “He was beaten repeatedly and given electric shocks even when he offered no resistance,” said a statement from Mexico’s National Human Rights Commission. U.S. Border Patrol gave a far different account of the incident. The agency said Rojas was detained after crossing the border from Mexico. He signed papers agreeing to be deported without a hearing. He was taken in a van to the San Ysidro border crossing, where officers removed his handcuffs about 25 feet from the gate at the border. Rojas began fighting with officers, according to initial reports from the San Diego Police Department, which is investigating the case. One officer hit him with a baton and the other fired a Taser at him. Shortly afterward, they discovered Rojas had stopped breathing. They administered cardiopulmonary resuscitation and called for an ambulance, which took him to the hospital where he died, police said. Customs and Border Protection said in a statement that Rojas “became combative,” leading officers to “subdue the individual and maintain officer safety.” In nearby Mexicali, a group of protesters from the Mexicali Civic Front blocked the international boundary between Mexico and the United States for about five minutes Monday to protest what they say was police brutality against Rojas. The group is using the incident to call for civil rights groups in Southern California and Mexico to join in an effort to protect immigrants from harsh treatment. The Mexican Bishops Conference said the beating of Rojas was a sign of racism similar to Arizona’s recently approved law SB 1070. The law authorizes police in Arizona to stop and question anyone they suspect of being an illegal immigrant. It also imposes tough fines and jail time on anyone in the United States illegally. The law has raised a firestorm of condemnation from Latin American countries since Arizona’s governor signed it April 23. President Obama is one of the law’s critics. He met with Peruvian President Alan Garcia Monday in Washington, largely to discuss economic policy. Garcia also urged Obama to reform immigration laws.
