ShareThis January 28, 2010 10:30 a.m. EST Topics: United States, Politics, War Crime, Crime, Law and Justice Kris Alingod - AHN Contributor New York, NY, United States (AHN) - New York City Mayor Michael Bloomberg on Wednesday raised concerns about the U.S. government's plan to try the alleged mastermind of the 9/11 attacks and four other terror suspects in Manhattan. The mayor's remarks contradict his previous statements supporting the Obama administration's decision to prosecute the suspects in civilian courts. "It would be great if the federal government could find a site that didn't cost a billion dollars, which using downtown will," Bloomberg told reporters, according to the New York Times. "Can we provide security? Yes. Could you provide security elsewhere? Yeah, and I mean - the suggestion of a military base is probably a reasonably good one.... They tend to be outside of cities so that they don't disrupt other people," he added. Bloomberg last year made clear his support to the Obama administration's decision. "It is fitting that 9/11 suspects face justice near the World Trade Center site where so many New Yorkers were murdered. We have hosted terrorism trials before, including the trial of Omar Abdel-Rahman, the mastermind of the 1993 World Trade Center bombing," he had said. Last November, the Justice Department said it would try five prisoners suspected of the 9/11 attacks in U.S. federal courts amid criticisms from conservatives about the use of civilian courts, instead of military commissions. "Just as a sustained campaign against terrorism requires a combination of intelligence, law enforcement and military operations, so must our legal efforts to bring terrorists to justice involve both federal courts and reformed military commissions, "Attorney General Eric Holder said then. No date has been set for the trial of Walid Muhammed Salih Mubarak Bin Attash, Ramzi Bin Al Shibh, Ali Abdul-Aziz Ali, Mustafa Ahmed Al Hawsawi and Khalid Sheikh Mohammed, allegedly the mastermind of the attacks. The proceedings will be held in the U.S. District Court for the Southern District of New York. Holder says prosecutors would seek the death penalty for each of the 9/11 suspects. He also has assured Congress the suspects would not have a platform to preach their beliefs as a result of the trial. "Khalid Sheikh Mohammed will have no more of a platform to spew his hateful ideology in federal court than he would have in military commissions," Holder said in a congressional hearing in November. "Before the commissions [in 2008], he declared the proceedings an 'inquisition,' condemned his own attorneys and our Constitution, and professed his desire to become a martyr. Those proceedings were heavily covered in the media, yet few complained at the time that his rants threatened the fabric of our democracy." Bloomberg's latest comments come amid continued efforts from some lawmakers to use military commissions instead. "The attacks of 9/11 were acts of war, and those who planned and carried out those attacks are war criminals," six senators said in a letter to Holder on Tuesday. "We and many others have already expressed serious concerns about whether a trial in civilian court might compromise classified evidence... Such a trial would almost certainly become a recruitment and radicalization tool for those who wish us harm." The letter was sent by Sens. Susan Collins (R-ME), Lindsey Graham (R-SC), Joe Lieberman (IND-CT), Blanche Lincoln (D-AR), John McCain (R-AZ) and Jim Webb (D-VA). New York Gov. David Paterson has also criticized the trial venue. "We're still having trouble getting over it, we still have been unable to rebuild that site," the governor said late last year, referring to the World Trade Center site. "And having those terrorists tried so close to the attack is going to be an encumbrance on all New Yorkers." But some leading conservatives have also backed the White House. Americans for Tax Reform President Grover Norquist, American Conservative Union Chairman David Keene and Bob Barr, 2008 Libertarian presidential nominee, have said in a joint statement, "The scaremongering about these issues should stop." "Civilian federal courts are the proper forum for terrorism cases," they added. "Civilian prisons are the safe, cost effective and appropriate venue to hold persons convicted in federal courts... Likewise the federal prison system has proven itself fully capable of safely holding literally hundreds of convicted terrorists with no threat or danger to the surrounding community." The trial is part of efforts to shutter the U.S. Naval Base in Guantanamo Bay, where the Bush administration used controversial interrogation techniques such as waterboarding. Republicans oppose closing the facility because the nation is still at war, and they say no other facility is capable of "safely and humanely" holding top terror suspects. Congress last year passed legislation allowing detainees into U.S. soil only for prosecution. The Military Commissions Act of 2009 bans the release of Guantanamo prisoners to the United States but allows them to be transferred for trial 45 days after the administration submits an assessment to Congress of the risks involved in doing so.
