The former Soviet Central Asian nation's human rights record has been under close international scrutiny since the start of the year, when it took over the rotating chairmanship of the Organization for Security and Cooperation in Europe, a prominent trans-Atlantic security and democracy body. Amnesty said that ill-treatment in the Kazakh justice system has been compounded by a climate of impunity. "Authorities must adopt a zero tolerance approach to torture and they are reneging on their international commitments by refusing to tackle this issue," said Halya Gowan, Europe and Central Asia program director for Amnesty. Kazakh officials could not be reached for comment on the report on Monday, a national holiday. The government has previously acknowledged that the nation had problems with torture, but insisted that it has taken efforts to address the issue. Last month, law enforcement agencies signed an accord with civic organizations to cooperate in preventing torture. Amnesty said that the Kazakhstan Coalition against Torture, a non-governmental organization, registered around 600 instances of torture over an 18-month period between 2007 and 2009. However, only a handful of police officers are prosecuted for torture each year, the rights group said. It said that most instances of torture in Kazakh police stations happen before detainees have been formally registered, which by law should take place within three hours of a suspect being apprehended. However, detentions are sometimes not registered for several days, during which detainees are deprived of access to legal representatives, doctors and family members, the report said. It said abuse of detainees is in part caused by the Kazakh justice system's method of evaluating police officers' job performance by conviction rates, putting pressure on law enforcement officials to secure guilty verdicts by any means. In one 2008 case cited by the report, Dmitri Tian was summoned to a police station in Astana to be questioned as a witness in a murder case. He said he was stripped to his underwear, made to stand with his legs wide apart, and beaten with plastic bottles filled with water and truncheons to make him confess to the crime. He said that his detention was not recorded and that the police officers did not inform him of his rights. Amnesty said many innocent suspects agree to sign confessions, which are later admitted as evidence in court, under such ill-treatment. The report said judges frequently base their verdict on confessions. Amnesty said independent monitors have only been given sporadic access to detention facilities. "Authorities must allow independent monitoring mechanisms to undertake unannounced visits to all detention centers," Gowan said.
