Afghan parliament deal brings protest, uncertainty

KABUL, Afghanistan – About 200 people gathered outside a mosque in Afghanistan's capital Sunday to protest President Hamid Karzai's decision to inaugurate the newly elected parliament this week rather than waiting a month for ongoing election fraud investigations.
The protesters crowded around losing candidate Najibullah Mujahid of Kabul province, who shouted through a megaphone that the president had caved to outside pressure.
"This is an illegal parliament! This parliament should not be inaugurated!" Mujahid said. His supporters said that thousands of votes that had been cast for him had never appeared in the tally.
It was a fairly minor interruption to the day, especially compared with the standoff that many had feared between winning parliamentarians and the president before a last-minute deal was struck late Saturday night.
Sunday had been the originally appointed day for the 249-member parliament elected in September's balloting to take their seats and begin work. But Karzai announced last week that he would delay the opening of the parliamentary session one month to allow further fraud investigations by a judicial tribunal. The winning candidates vowed to convene parliament on their own Sunday in protest.
The standoff was averted after hours of meetings Saturday after which the legislators-elect said that they reached a compromise with Karzai in which he would inaugurate the session Wednesday _ just three days late _ as long as the investigations would continue.
The president's office could not be reached for comment. The lawmakers said they planned to send a formal letter to the president Sunday endorsing the compromise. It could not be immediately confirmed if the letter had been sent.
Investigations could still wreak havoc on the parliament as it begins work this week. While the judicial tribunal appointed to reinvestigate fraud in the election has been rejected as unconstitutional by the Afghan electoral bodies and the international community, the judges say they can overturn results or even nullify the election.
And even if the court does not try to change results of the vote, a conviction of any candidate for fraud could give them basis for revoking their seat. The Afghan constitution says that no one who has been convicted of a crime can run for seat in the legislature.
There are 59 winning candidates among the cases the court plans to consider, according to Sadiqullah Haqiq, the head of the five-judge tribunal. The tribunal had requested the delay to finish looking into these cases. A spokesman for the tribunal declined to comment on Karzai's change of heart.
The authority of the legislature has already been thrown into question by the renewed investigation after the official anti-fraud watchdog completed an extensive probe. The anti-fraud panel threw out 1.3 million ballots _ nearly a quarter of the total _ and disqualified 19 winning candidates before final results were issued on Nov. 24.
While Karzai has regularly steamrolled over the parliament by issuing orders by decree, the body is still the main check on the president's power and an important dissenting voice. The Supreme Court is nominated by Karzai and generally seen as beholden to him.
As the political turmoil continues, so does violence countrywide.
Two Afghan children were killed Sunday when they were caught up in a firefight between insurgents and allied NATO-Afghan forces in the east, NATO said in statement, which maintained that it was insurgent gunfire that killed them.
In the south, a police officer was killed by a roadside bomb in Helmand province on Saturday, the government said.
