Search web search Home Singapore Asia Pacific World Business Entertainment Sports Technology Africa Europe Latin America Middle East North America Ukraine court strengthens president's powers AFP - Saturday, October 2 Send IM Story Print KIEV (AFP) - – Ukraine's constitutional court Friday strengthened the powers of President Viktor Yanukovych by annulling 2004 amendments that boosted parliament, sparking opposition claims of creeping authoritarianism. The ruling -- prompted by a petition from more than 250 pro-Yanukovych MPs in the Ukrainian parliament -- overturned the 2004 changes in favour of the original version of Ukraine's 1996 constitution. "The court has ruled that the 2004 amendments to the Ukrainian constitution were unconstitutional due to violations of constitutional procedures in their examination and adoption," said Anatoly Golovin, the head of the court. The 2004 changes gave lawmakers the powers to appoint key ministers like the prime minister, defence minister and foreign minister on the recommendation of the president, although other ministerial appointments are the preserve of the premier. The amendments also increased the term of parliament from four years to five. The pro-Western opposition swiftly attacked the court and the Kremlin-friendly Yanukovych, who took power earlier this year after defeating the pro-Western leaders of the Orange Revolution. "The court has discredited itself. This decision borders on an abuse of power," said Olena Shustik, deputy head of the parliament faction of opposition leader Yulia Tymoshenko. Dismissing the constitutional court chief as a "puppet", Tymoshenko said that "from this moment Ukraine has... become another country," online newspaper Ukrainska Pravda reported. Andriy Paruby of the opposition Our Ukraine faction said that Yanukovych's Regions Party "had taken a path whose aim is not to observe the law but give President Yanukovych as many powers as possible." Yanukovych's representative on the constitutional court, Olena Lukash, told the Interfax-Ukraine news agency the court's decision meant Ukraine had returned to its original constitution with immediate effect. In an address to the nation after the court's decision, Yanukovych said he backed the idea of a nationwide referendum on political reform although he did not give further details. The constitutional amendments were agreed in 2004 under former president Leonid Kuchma, just before the pro-Western faction led by Viktor Yushchenko was swept to power in the Orange Revolution uprising. Ironically, the changes at the time were opposed by pro-Western politicians who condemned them as a bid by the outgoing Kuchma to undermine the powers of the president if Yushchenko won power. The move is likely to please Russia, which has already been delighted by Yanukovych's alacrity to repair ties damaged by the Orange Revolution leaders who sought to steer the country towards the West. Russian President Dmitry Medvedev has repeatedly expressed alarm at changes agreed in Kyrgyzstan to move the ex-Soviet Central Asian state from a presidential system to a parliamentary democracy. Former 2008 Republican presidential candidate John McCain said the move had reversed years of progress in the country. "I am saddened and concerned that today's ruling by Ukraine's Constitutional Court could lead to a harmful centralisation of power and a weakening of democracy in Ukraine," said the veteran lawmaker, who spoke about the situation by telephone with Tymoshenko. Yanukovych has insisted he is still targeting European integration for his country but he told a conference in the Black Sea city of Yalta the European Union had lost interest in Ukraine becoming a member. "Since the European Union is not ready even to discuss Ukraine's membership we will ourselves choose the pace, forms and methods of integration in accordance with our national interests," Yanukovych said.
