Democracy leader Aung San Suu Kyi, who has spent much of the past 20 years in detention and is seen as the biggest threat to the junta, is barred from standing in the polls because she is a serving prisoner. The election date, announced by state media, falls about a week before Suu Kyi's current term of house arrest is due to expire on November 13. Her party, the National League for Democracy (NLD), won a landslide victory in 1990 but was never allowed to take office. It is boycotting the upcoming vote, saying the rules are unfair. Opponents say the ruling generals are taking no chances this time, reserving one quarter of the seats in parliament for the military and crafting election rules to make sure that junta-backed parties have the upper hand. "The military regime learnt their lessons so they are trying all possible ways to ensure this election is won by their parties," said Thai-based activist Naing Aung of the Forum for Democracy in Burma -- Myanmar's former name. A group of former NLD members has formed a new party, the National Democratic Force (NDF), to stand in the election -- a move that has put it at odds with Suu Kyi, who was opposed to participating in the polls. The NLD decided not to contest the vote because of rules laid down by the junta that in effect would have forced it to expel Suu Kyi and other members in prison in order to participate. The election "cannot be free and fair", the NLD's long-time spokesman Nyan Win told AFP. "We still don't have freedom of expression and freedom of information." Under strict election rules, members of all parties are banned from marching, waving flags and chanting to garner support. They must apply one week in advance for permission to gather and deliver speeches outside their offices. Parties must also register their election candidates by August 30, leaving them little time to prepare. In any case, without Suu Kyi, few think any of the opposition groups could repeat the NLD's landslide victory in 1990, two years after it was formed in response to a popular uprising against the junta that left thousands dead. Among the opposition parties not boycotting the vote, the NDF so far seems to have the best chance of success, according to Win Min, a Burmese academic at Chiang Mai University in northern Thailand. "But they have serious financial problem even to travel to local areas to recruit candidates," he said. Given restrictions placed on opposition parties running in the election, they are unlikely to win a majority, but may secure about 10 percent of seats in parliament, he predicted. So far 40 parties have been allowed to register for the polls, but some are already expressing concerns about conditions for the vote. One pro-democracy party said this week it had complained to the election authorities about intimidation of its members by security personnel. Another party head resigned last week and said he would not participate in the election because it would not be free and fair. The United States voiced concern last month about what it described as "a flawed electoral process" in Myanmar, which faces strict Western sanctions because of its human rights record. In April Thein Sein and other ministers retired from their military posts to form the Union Solidarity and Development Party (USDP), a move seen as converting the leadership to civilian form ahead of the election. The USDP received a major boost after the Union Solidarity and Development Association (USDA) -- a powerful pro-junta organisation with deep pockets and up to 27 million members -- recently merged with it. New York-based Human Rights Watch described the move as "clear evidence" that the polls will not be legitimate, noting that the USDA has been implicated in past attacks on Suu Kyi and intimidation of opposition protesters.
