The embattled organization sued the government last month. The Government Accountability Office said on Friday it would investigate the group's use of public funds. The government's lawyers are asking the courts to reconsider a preliminary injunction issued by U.S. District Judge Nina Gershon last Friday. A hearing has been set for Dec. 22 on the motion. Rep. Darrell Issa (R-CA), who led efforts on Capitol Hill to defund ACORN, praised the Justice Department for "upholding the bipartisan will of Congress." The ruling gave ACORN a small victory in it lawsuit accusing lawmakers of approving a bill of attainder, or legislation that targets groups or individuals punitively without trial. The suit, filed by the Center for Constitutional Rights, also says Congress violated the Fifth Amendment right to due process, and the First Amendment right to freedom of association by targeting organizations affiliated and allied with ACORN. The Center for Constitutional Rights on Friday filed a motion asking Gershon to amend her ruling to include the new federal budget provisions signed into law by President Barack Obama the previous day that also called for halting federal funds for the group. The same day, however, the Government Accountability Office said it would provide Congress with a report about ACORN's use of government funds. The largest advocacy group for low-income people in the nation, ACORN has received more than $53 million in federal funds since 1994 excluding those it has obtained indirectly through states and localities, according to House Republicans. Congress moved in September to keep the group from continuing to receive federal funds, in the wake of videos taken covertly by conservatives that appear to show ACORN staff giving illegal advice. The House voted a 345-75 to approve the Defund ACORN Act, which was introduced by Minority Leader John Boehner (R-OH). In the Senate, an amendment from Sen. Mike Johanns (R-NE) that prohibits the group from receiving funding from the Interior Department was approved by a vote of 85-11, while another measure barring ACORN from getting any federal housing and transportation funds passed by 83-7. But a two-month independent internal review by former Massachusetts Attorney General Scott Harshbarger has found that ACORN employees did not engage in illegal activities when they gave housing and tax advice to two conservative activists, Hannah Giles and James O'Keefe, taking secret footage of the interactions. Disguised as a prostitute and a pimp, Giles and O'Keefe had sought assistance from the group and had apparently received advice on how to evade the law, such as for Giles to declare her profession as a "performance artist" instead of a prostitute. Harshbarger had said in his review, "The videos that have been released appear to have been edited, in some cases substantially, including the insertion of a substitute voiceover for significant portions of Mr. O'Keefe's and Ms.Giles's comments, which makes it difficult to determine the questions to which ACORN employees are responding."
