Winnipeg, Manitoba (AHN) - Court of Queen Bench Justice John Scurfield declared on Thursday that bus beheader Vince Li is not criminally responsible for killing and decapitating Greyhound bus rider Tim McLean.
In lieu of a 25-year life sentence for second degree murder, Li may be confined for life in a psychiatric facility. Judge Scurfield said he was aware his ruling will generate controversy, but he stood by his decision.
Scurfield said, "I am satisfied beyond a balance of probabilities, that Li suffers from a major mental disorder that rendered him not criminally responsible for the killing of Timothy McLean."
The McLean family naturally disagreed with the decision and spoke against it. Vana Smart, McLean's older sister said, quoted by the Globe and Mail, "He is getting away with murder... After the review board decides that he can be medically managed in the community... he will be able to pursue his life as he pleases."
The 40-year old Li will have to undergo a mental-health review within 90 days and yearly reviews to find out if he is fit for release. Li will not have a criminal record for his act. McLean's mother promised to stop Li's from being set free.
Li claimed hearing God's voice which led him to commit the gruesome act.
