ADVERTISEMENT "The defendant, Marwoto Komar, is legally and convincingly guilty of criminal negligence resulting in the jet's crash and the deaths of other people," chief judge Sri Andini told the Sleman district court. The court decided to hand down the heavy sentence, an unusual legal move by international standards, because of the number of deaths and the fact that Komar "never expressed remorse during the trial," Andini said. The sentence was lighter than the four years demanded by prosecutors for Komar's actions as he attempted to land the Boeing 737 at high speed at Yogyakarta airport on March 7. The plane burst into flames after skidding into rice fields of the airport runway. Five Australians, diplomatic staff and journalists, were among the dead. Komar, who wore his pilot's uniform in court despite being fired from the national flag carrier over the crash, told the court he would appeal against the verdict. The pilot maintained at his trial that faulty wing flaps were to blame for the jet's excessive airspeed as it came in to land. However a report by an Indonesian safety committee found that Komar had ignored 15 automatic warnings telling him he was coming in too fast. The plane was carrying Australian diplomats and journalists who had been in Indonesia for a counter-terrorism conference attended by then-foreign minister Alexander Downer. Australia's Foreign Affairs Department refused to comment on the sentence but Downer said it was "very light." "It seems a very light sentence frankly," Downer told Australian commercial radio from London. "I understand from the evidence that was presented that there was nothing mechanically wrong with the aircraft and that the pilot just landed the plane at far too high a speed, way over the limit of the landing of an aircraft." Downer said the crash had been a sad event for him personally as he knew those who died. "I do feel quite strongly about it because we had been together the previous day at the counter terrorism conference in Jakarta with (foreign affairs official) Liz O'Neill, who was killed," he said. "We were having a drink at the ambassador's residence and the next morning she was dead. It's pretty sad." Indonesia has a chequered history of air disasters and mishaps. Also in 2007 an Adam Air plane crashed off Indonesia's Sulawesi island, killing all 102 people on board. The European Union has banned Indonesian airlines from its airspace since June 2007 due to safety concerns. On Monday a military training plane crashed into a hangar at an air base in West Java, with all 24 crew and passengers killed.
