But a Navy captain who said he thought prisoners were harshly treated in the camp's early years was one of seven officers chosen to try Toronto native Omar Khadr, who was 15 years old when captured in Afghanistan in 2002. Opening statements are scheduled for Thursday in his trial on charges that include conspiring with al Qaeda and murdering a U.S. soldier with a grenade during a battle in Afghanistan. Fifteen anonymous jury candidates were questioned over two days in a courtroom at the Guantanamo Bay naval base. They provided a small sampling of U.S. military officers' opinions of the controversial detention camp for suspected terrorists. The rejected Army officer, a lieutenant colonel who had served in Europe and specialized in nuclear arms control, said "America seemed to lose its status as a beacon of freedom, liberty and justice" by conducting extrajudicial renditions, holding prisoners in secret locations and treating others inhumanely in Afghanistan and at Guantanamo. "I don't believe my position is any different from the president's," he said. President Barack Obama has tried unsuccessfully to shut the Guantanamo detention camp and banned cruel, degrading or inhumane treatment. Prosecutor Jeff Groharing, a former Marine major, said that Army officer showed "a decidedly hostile view of the government" and tried to have him dismissed as biased. "He said repeatedly he agrees with the president!" Groharing exclaimed. The judge refused to exclude the man but Groharing used the prosecution's lone peremptory challenge to dismiss him without having to give a reason. The Navy captain chosen for the panel said he thought Guantanamo was politically "a no-win situation" that led to bad relations with other nations. He said a friend who served as a battalion commander at Guantanamo had told him detainees were treated harshly in 2002 and 2003 but that it was now "a kinder, gentler place." Khadr claims he was abused at Guantanamo during that period and was coerced into giving false confessions, something the defense will be allowed to mention when Khadr's statements to interrogators are used evidence. An Air Force Lieutenant Colonel said Guantanamo was "probably the best place for the purpose that it's serving right now" and that the detention camp should stay open. She was dismissed from the jury pool for cause after saying a friend had been badly hurt by an improvised explosive device in Afghanistan. Khadr is accused of planting roadside bombs targeting U.S. troops and the jury will see a videotape of him making and planting them with a group of al Qaeda operatives. His defense lawyer, Army Lieutenant Colonel Jon Jackson, used his sole peremptory challenge to boot an Army colonel who also had friends and unit members injured by such explosives in Iraq. TxCharlie Report As Abusive     Aug 11, 2010 9:33pm EDT Guantanamo was created so that we, the U.S. were not obliged to extend U.S. Constitutional protections to the inmates because they were not on U.S. soil. If you are on U.S. Soil you are protected. This is the same reason, the inmates are being tried in Guantanamo, so that they can continue to be denied U.S. Constitutional protection, whether guilty or innocent. I believe the U.S. criminal justice system is adequate as built and that it is designed to prevent our own government from abusing people and acting “outside” the law. One can infer that our government must have done something wrong from the trial location and that their evidence is “fruit from the poison tree” and would be thrown out as tained in any criminal court on U.S. soil. Coerced confessions are inherently unbelievable and it is embarrassing that my own government continues to act this way, skirting its own laws so it can run around rogue. If they can do it now, they can do it later, and to anyone they choose. Not a good precedent to set. Really disappointing. KimoLee Report As Abusive     Aug 11, 2010 9:54pm EDT TxCharlie – This is not an “official” war, so the actual “Rules of War” probably do not apply and even if they did, I seriously doubt they were followed. Guantanamo is designed to “avoid” the law and the rules that apply to their treatment. The last time Congress officially declared war was WWII. Keeping things “unofficial” makes it easier for the president to continue funding wars the public does not fully support, like Viet Nam. Our government officials are pretty clever about the way they do business! Just hope you are never on the “wrong” side.
