ShareThis June 29, 2010 6:49 a.m. EST Topics: government, politics, public officials, election, United States Kris Alingod - AHN News Contributor Washington, DC, United States (AHN) - The special election to fill the Senate seat of the late Robert Byrd will be held in 2012 because of West Virginia's complicated succession law. Secretary of State Natalie Tennant said in a statement late Monday that a replacement will be appointed to the seat since Byrd had more than two years and six months left in his term, which expires in January 2013. The appointee will serve until the seat is filled in an election, which cannot be held this November because state law requires candidates for such a vacancy to file during the filing period. The filing period ended last month. The special election will thus be held in 2012, with a little over a month remaining in Byrd's term. The regular election for the full term will also be held that year. Tennant called the situation "unique." “The winner of the unexpired term would serve out the final five weeks or so until the new term of Congress starts in January of 2013," she said. West Virginia Gov. Joe Manchin has been reported as a potential 2012 candidate for the seat. He is expected to appoint a fellow Democrat as a caretaker, keeping the balance of power in the Senate following Byrd's death. Caretakers who didn't run in special elections were also appointed to the Senate seats of the late Ted Kennedy and Vice President Joe Biden. Rep. Shelley Moore Capito (R-WV) has been named a likely Republican candidate for 2012. Questions about the state's succession law were raised following Byrd's passing, with pundits pointing out that the legendary senator's more than half a century in service had kept such issues remote. There were also concerns about legal challenges to the state code. Tennant, however, made clear in her statement, "There was a legal case in 1994 decided by the West Virginia Supreme Court of Appeals that upheld that position of requiring candidates to file during the filing period." Byrd, who was the longest-serving member of Congress in the nation's history, succumbed to failing health in a Virginia hospital before dawn on Monday. A shipyard welder and a local Ku Klux Klan leader who rose through the ranks and became one of the most powerful and respected lawmakers in the U.S. Senate, Byrd had called his past as a Klansman his "great mistake" and "that albatross… [that] will be in my obituary.” Byrd served as state senator for two years before beginning one of his three terms in the U.S. House of Representatives. He never lost an election campaign and was in his ninth term in the Senate when he passed away.
