ADVERTISEMENT The Nobel laureate's lawyers presented appeal documents to a Yangon divisional court mid-afternoon, asking the court to overturn a ban on three of four witnesses whom she called to give evidence at her closed-door trial. "We gave our statement this afternoon to the divisional court because the original decision regarding the three witnesses was not legal," said her spokesman, Nyan Win, who is also one of her three-man defence team. Nyan Win said the judge announced that a ruling would be made on the appeal on Tuesday, June 9. "If they accept these three witnesses, the case needs to be heard again," he told reporters near the court, amid tight police security. Aung San Suu Kyi faces up to five years in jail on charges of breaching the conditions of her house arrest after a bizarre incident in which an American man, John Yettaw, swam to her lakeside home in May. The 63-year-old opposition leader, who has been imprisoned for 13 of the past 19 years and has recently been in poor health, was now well and "very surprised" by the court's decision to hear her appeal, Nyan Win said. "Daw Suu is in good health. She knew about the appeal when we told her. She is very surprised," he said. The three barred witnesses were Win Tin, a dissident journalist who was Myanmar's longest serving prisoner until his release in September; Tin Oo, the detained deputy leader of her party; and lawyer Khin Moe Moe. The prosecution have presented 14 witnesses, mostly policemen, and the defence team say this shows the junta's case against her is one-sided. Earlier Friday Aung San Suu Kyi appeared in court at Insein prison, where she is being detained, to hear her trial formally adjourned until June 12. Dozens of supporters gathered close to the prison gates as 10 police trucks and plain-clothes policeman patrolled nearby. US military veteran Yettaw also appeared at Aung San Suu Kyi's hearing and met her main defence lawyer, Kyi Win. "He (Yettaw) came over and shook my hand. In fact, he cried. He said to me 'You know this trial is good. She's still alive'," Kyi Win told reporters. Devout Mormon Yettaw has said he swam across Inya lake in homemade flippers to Aung San Suu Kyi's prison home after having a vision that she would be assassinated. Kyi Win said he apologised to Yettaw for previously calling him a "fool" for his actions. US President Barack Obama has described the court proceedings as a "show trial" while Myanmar's usually reticent Asian neighbours have expressed strong concerns.
