Share September 13, 2010 9:31 a.m. EST Topics: politics, defense, armed forces, trials, gays and lesbians, minority group, social issue, court preliminary, crime, law and justice, United States Kris Alingod - AHN News Contributor Tacoma, WA, United States (AHN) - The trial of a woman discharged from the Air Force for her sexual orientation begins Monday, less than a week after a federal court declared as unconstitutional the military's ban against gays serving openly. The case of former Maj. Margaret Witt will begin proceedings before a federal district court in Tacoma. The lawsuit was originally dismissed but a federal appeals court returned it to the district court in 2008, saying the Air Force had to prove the dismissal was crucial to the "good order, morale and discipline" of personnel in Witt's unit. Government lawyers had argued that Witt's discharge under "Don't Ask, Don't Tell" ensures military readiness. Witt served in the Air Force for 19 years, including in Oman during Operation Enduring Freedom. She was in a committed relationship with a civilian woman when the Air Force began a probe in 2004 into her sexual conduct. Her trial, which is expected to last at least a week, comes after a federal judge in California ruled that the ban on gays in the military violates the constitution and has a "direct and deleterious effect" on troops. The lawsuit was filed by a gay advocacy group, the Log Cabin Republicans, seeking to overturn DADT and has no bearing on Witt's case. The Defense Department is reviewing the effects of repealing the policy on morale and military readiness. The 10-month review is being conducted by the Pentagon's top lawyer and Army Gen. Carter Ham, the commander of U.S. Army Europe. Military leaders have warned a repeal could affect troops engaged in two wars, and the Pentagon has repeatedly said any legislation should be introduced after it completes its review in December. The White House is supporting a Democratic bill repealing the law. The proposal is part of a defense authorization bill and would only begin a process of overturning the ban after the Defense Department completes its review.
