Washington, D.C., United States (AHN) - The Obama Administration has filed papers asking California's Judge Virginia Phillips to stay her ruling suspending the military’s “don’t ask, don’t tell” policy. The Justice Department asked Phillips to allow the military to continue with the allegedly discriminatory policy, which prohibits serving gay and lesbian U.S. service members from openly divulging their sexual orientation.
In remarks at a televised town hall in Washington, D.C., with scores of college students and younger voters, Obama told his audience, “I’m against 'don’t ask, don’t tell' and we’re going to end this policy.”
Explaining his reluctance to do away with the DADT law with an executive order, Obama said, “The difference between my position right now and Harry Truman’s was that Congress explicitly passed a law that took away the power of the executive branch to end this policy unilaterally. So this is not a situation in which with a stroke of a pen I can simply end the policy.”
Addressing the hourlong event, presented by MTV News, BET News and Country Music Television, Obama said, “We are moving in the direction of ending this policy. It has to be done in a way that is orderly, because we are involved in a war right now. But this is not a question of whether the policy will end,” stressing, “This policy will end and it will end on my watch.”
On another question if he thinks being gay is a choice, President Obama told his young audience, “I don’t think it’s a choice. I think that people are born with a certain makeup, and that we’re all children of God. We don’t make determinations about who we love,” reiterating, “that discrimination on the basis of sexual orientation is wrong.”
Uncertain of the outcome of consultations within the Justice Department, Cynthia O. Smith, DoD Spokeswoman earlier in a statement noted, “the US Government is contemplating whether to appeal and to seek a stay of the injunction.”
"The Department of Defense will of course obey the law... in the meantime, the Department will abide by the terms in the court's ruling, effective as of the time and date of the ruling,” the statement explained. "We have no further information or comment at this time, but when and if we do, we will provide that to you.”
