The 249-seat lower house of parliament, or Wolesi Jirga, has been in recess for the last three weeks, as disputes and protests have rumbled on over the outcome of September's fraud-hit nationwide poll. The top prosecutor, a key Karzai aide, opened a criminal investigation into the vote after the Independent Election Commission (IEC) announced that 24 early winners, among them allies of the president, had been disqualified. The prosecutor has arrested 12 people and summoned four poll officials. But the IEC endorsed the final 11 lawmakers on Wednesday and insisted that no authority had the right to overrule its decision. "The final results... announced by the IEC are final and according to electoral law no government institution can change these results. This electoral process is now over," IEC head Fazel Ahmad Manawi told reporters. Neither the prosecutor's office nor the presidency were immediately reachable for comment, but the European Union and the US embassy welcomed the outcome. "We now look forward to the timely convening and inauguration of the newly elected lower house... and to the resumption of the national assembly's important legislative functions," said the EU embassy in Kabul. "There were irregularities and fraud in this election, but the Independent Election Commission (IEC) and the Electoral Complaints Commission (ECC) have worked well within the framework of the electoral law and Afghan Constitution," a US embassy statement said. "We look forward to the opening of the new parliament so that it can begin taking up its important Constitutional role on behalf of the Afghan people," it said. The vote appears to have weakened Karzai's support in parliament amid a worsening nine-year Taliban insurgency. Pashtuns, Karzai's power base, are thought to have around 88 seats. His main opponent, Abdullah Abdullah, claims to control more than 90 seats. Failed candidates have taken to the streets to protest over the election. Manawi on Wednesday endorsed preliminary results in Ghazni, a majority Pashtun province in the south, which returned 11 Hazara lawmakers. "We respect debates over the election results in Ghazni and we understand the president's concern, but we have a job to do, and that is to obey and implement the law," said Manawi. Election officials threw out a quarter of votes cast in the September 18 poll after processing more than 5,000 fraud claims. Deputy attorney general Rahmatullah Nazari had asked the IEC to delay any final announcement until prosecutors wrapped up their criminal inquiry into allegations of fraud and bribery. Four officials from the IEC and ECC have been summoned by the attorney general's office for questioning, and Nazari said the supreme court would make a final ruling on the election outcome. But Abdullah and one of the accused officials -- ECC commissioner Ahmad Zia Rafat -- have accused the attorney general of launching a politically motivated probe intended to sway the outcome of the vote. None of the officials summoned have yet turned up to the attorney general's offices and Manawi defended their work. "We don't claim that the election was totally flawless but I want to reiterate that the commission never did anything deliberate in favour or against anyone."
