Technology Leslie Carr sought to recover $60 million for trauma, which she said kept her from publishing on the Web. She alleged, among other things, that each time she used the laptop to go online, "there would be a mass number of Apple employees waiting greedily like vultures to survey and monitor my life." But U.S. District Judge Richard Berman said the complaint "fails to state a plausible claim for relief. Where, as here, a complaint is asserting unrealistic and unsupportable claims, a court may dismiss it." Carr did not return a call seeking comment. The case is Carr v. Apple Inc, U.S. District Court, Southern District of New York, No. 09-09777. I certainly was unaware that store employees can’t watch to see what “customers” are doing. I’m really surprised that this woman felt that a store laptop was really her own personal computer. I would think she’d be much better off just buying a Mac and take it home to use as a personal computer. Occasionally I do see people in supermarkets eating fruit or opening boxes to “sample” food. I guess those “customers” feel they’re well within their rights to eat as much as they can before leaving the store. Humans certainly know how to stretch their rights. I’ve heard that people do spend hours on Macs at Apple retail stores to do their work and upload videos or make phone calls and stuff, but taking Apple to court because store employees are checking to see what you’re doing on store computers is really pushing the limits.
