The bill is a response to the attempted car bombing last week in New York’s Times Square. An American citizen of Pakistani origin was arrested after the bomb was dismantled by police. The proposed Terrorist Expatriation Act would authorize the State Department to revoke citizenship of anyone who supports al Qaeda or other terrorist groups or who helps in attacks against the United States or its allies. Identical bills were introduced this week in the House and Senate. “We’re fighting an enemy who doesn’t wear the uniform of a conventional army or follow the law of war,” said Sen. Joseph Lieberman (I-CT), who co-sponsored the Senate bill. “Those who join such groups join our enemy and should be deprived of the rights and privileges of U.S. citizenship and the ability to use their American passports as tools of terror.” The bill would expand a 1940 federal law that authorizes the State Department to strip Americans of their citizenship. Under the 1940 law, Americans could lose citizenship for serving in the military of a country at war with the United States, for treason or for voting in another nation’s elections. However, they later could contest their loss of citizenship in court. The Supreme Court narrowed the authority of the 1940 law by ruling Americans could lose citizenship only if they renounce it. The 1967 ruling involved the case of a naturalized American born in Poland who voted in an Israeli election. The State Department took away his citizenship but he won it back in the Supreme Court case. Unless the Supreme Court changes its decision, the Terrorist Expatriation Act is likely to be overturned in court shortly after Congress approves it, according to legal scholars. Sen. Chuck Schumer (D-NY) was among the first members of Congress to recognize the conflict with existing laws. A spokesman for Schumer said the senator “believes it would be found unconstitutional in this context and would also be ineffective.” Civil rights activists also warned about possible conflicts with the Constitution’s right of equal protection for American citizens. Nevertheless, the bill is getting a lukewarm response from the Obama administration. Secretary of State Hillary Rodham Clinton came closest to endorsing the legislation. During a press conference she said, “Clearly, United States citizenship is a privilege. It is not a right… And people who are serving foreign powers – or in this case, foreign terrorists – are clearly in violation, in my personal opinion, of that oath which they swore when they became citizens. So we’re going to take a hard look at this.” Meanwhile, Faisal Shahzad, 30, the accused Taliban associate who admitted to planting the car bomb in Times Square, is providing police with “useful information,” Attorney General Eric H. Holder Jr. told a Senate subcommittee. Shahzad is charged with acts of terrorism transcending national boundaries, attempted use of a weapon of mass destruction and other federal crimes. He faces a potential sentence of life in prison if he is convicted. Shahzad has admitted he received bomb-making training during a recent five-month trip to his home country of Pakistan. However, some U.S. military personnel say he may have been acting alone. An FBI investigation is focused on following a money trail that allowed Shahzad to pay in cash for the SUV used in the bombing attempt with 13 $100 bills. Shahzad is unemployed but never has missed paying his rent, his landlord told investigators. The Times Square bomb was reported to police by a street vendor who saw smoke coming from a parked SUV, apparently after the bomb failed to detonate properly.
