Schwarzenegger To Swear In Lt. Gov. Nominee Despite Contested Vote

Sacramento,, CA, United States (AHN) - California Gov. Arnold Schwarzenegger plans to swear in his choice for lieutenant governor despite questions surrounding state Sen. Abel Maldonado's confirmation.
The state Assembly on Thursday voted 37-35 in favor of the Maldonado, a moderate Republican. The vote was short of the 41-vote majority in the chamber, which is controlled by Democrats.
The governor said in a statement, "Based on the votes taken... Senator Abel Maldonado will be sworn in as the next Lieutenant Governor." But Democrats have disputed Schwarzenegger's statement, citing state law. The chamber's top Republican, Martin Garrick, meanwhile, said the vote "put the arrogance and hypocrisy of the majority party in the State Assembly on full display."
"Lawmakers from both parties had the opportunity to come together and support the confirmation of a well-qualified Lieutenant Governor nominee," said Garrick. "It was once again extreme partisanship that carried the day."
The governor's legal secretary, Andrea Lynn Hoch, later insisted that a simple majority vote was not needed to confirm Maldonado.
"The California Constitution is clear: if the legislature does not act to refuse to confirm the Governor's nominee, his appointment moves forward. The Constitution only speaks to 'refusal' of confirmation," Hock said in a statement.
The 42-year-old Maldonado was nominated as lieutenant governor last November, when John Garamendi won a special election to the U.S. House of Representatives. He has been criticized as too conservative by Democrats while some Republicans have taken him to task for his support last year of a controversial state budget backed by Democrats that sought to close a $41 billion deficit.
A grassroots organization, the California Republican Assembly, also issued a letter this week asking state lawmakers to reject his nomination.
"He has contributed to unemployment in California by fighting to increase the state's minimum wage," the group said.
Maldonado was confirmed by the state Senate by a 26-7 vote. He was approved despite concerns from Senate President pro Tem Darrell Steinberg about the $2 million required to hold a special election for Maldonado's Senate seat that will be vacated to fill the post of lieutenant governor, for which an election will also be held.
Maldonado served in the state Assembly from 1998 to 2004 before being elected to the state Senate, where he is vice chairman of the committees on Food and Agriculture, and Human Services. He first entered politics in 1994, when he was elected to the Santa Maria City Council.
