ShareThis July 1, 2010 6:46 p.m. EST Topics: long term care, human interest, social issue, offbeat, justice and rights, curiosity, crime, law and justice, United States Windsor Genova - AHN News News Writer Los Angeles, CA, United States (AHN) - The California Assembly approved Thursday a $20 million settlement for Jaycee Dugard, who was kidnapped in 1991 when she was only 11 but was discovered by authorities only in 2009. The settlement, which was earlier approved by the governor but is still subject to another approval by the state Senate, had been recommended by California’s justice department after a study showed that a court settlement is likely to cost more than $20 million because of the tragic character of Dugard’s case. The settlement would protect the state from any future claims by the victims, according to Assemblyman Felipe Fuentes (D- Sylmar), author of the settlement bill, AB 1714. The settlement follows the filing by Dugard and her two daughters of damage claims with the California Victim Compensation and Government Claims Board. Dugard, whose children were fathered by her abductor, Phillip Garrido, sought compensation on grounds that the state committed negligence in failing to discharge its mandatory duty and caused her emotional distress. Garrido was charged with kidnapping Dugard outside her South Lake Tahoe home in 1991. However, his parole officers failed to check his Antioch home, where Dugard was kept captive for 18 years. Due to their long captivity and failure to get an education, the Dugards require life-long counseling because they are not equipped to face the challenges posed by society.
