Batavia, NY, United States (AHN) - A woman in upstate New York allegedly caught having sex on a park picnic table in broad daylight has been charged with adultery. She is now the 13th woman in the state's history to be charged with the crime.

A mother in the park spotted the woman allegedly fornicating on the picnic table Friday evening and called police. The responding officer knew the woman, 41-year-old Suzanne Corona. Furthermore he knew Corona was married. When questioned by police, she and her 29-year-old gentleman companion responded that they were just talking. A police spokesman says it was obvious they weren't just talking.

In addition to the adultery charge,, she and her paramour, Jason Amend are also charged with public lewdness. Amend has not been charged with adultery because, according to police, he did not know Corona was married.

Corona said in court Wednesday she plans to fight the constitutionality of the adultery charge. She contends that any children in the area could not have seen anything inappropriate.

“We were sitting there on the bench, fully clothed,” she said. “His genitals were exposed perhaps by the zipper, but that’s it.”

Because the officer walked up on them actually having intercourse, the police department said it fits the definition of adultery. If convicted, she could face up to 90 days in prison or a $500 fine.
