Chris Dodd (D-CT) is calling on Yale University to return artifacts to Peru taken by one of its professors more than a century ago from the ancient Inca ruins of Machu Picchu. The university is in engaged in a legal battle with Peru over ownership of the artifacts. "The Machu Picchu artifacts do not belong to any government, to any institution, or to any university. They belong to the people of Peru," Dodd, who visited Peru last week as chairman of the Senate Subcommittee on Latin America, said in a statement on Wednesday. The artifacts were excavated in 1912 by Hiram Bingham, then a professor in Latin American history at Yale University. The objects are now housed in the university's Peabody Library. Bingham's excavation was legal, according to the university, and at the time Peru's civil code allowed anyone who discovered artifacts to keep them. The scholar returned to Peru in 1914 but brought back materials from Machu Picchu that were on loan and that were returned after World War I because Peru's laws on archeological findings had changed. Yale University said it had worked with Peruvian officials to reach an agreement on the return of some objects from Bingham's 1912 expedition. Both parties negotiated a compromise in 2007 that would return "museum quality pieces, along with a substantial portion of study fragments" while allowing continued conservation and scholarly study of the artifacts. The accord involved a university-sponsored traveling exhibit of the pieces until such time that museum space in Peru was prepared to "meet standard technical requirements for security and preservation." Peru had signed the compromise but filed a lawsuit in 2008. The agreement would have allowed the university to temporarily keep some research materials, described by Yale as "bits and pieces of pots, bones, and other small fragments that are similar or identical to countless objects already in Peru." Peru's former first lady, Eliane Karp-Toledo, had opposed compromise, saying in a New York Times op-ed, "Peru’s sovereign right to the entire collection is not acknowledged, and it is clear that Yale would keep a significant proportion of the materials." "Why is it so hard for Yale to let go of these collections after almost a century of loan default? It is time for Peruvian scholars and citizens -- especially the indigenous descendants of those who led Bingham to the ancient complex -- to have access to the collection," Karp-Toledo added. Machu Picchu is a UNESCO World Heritage site located on a mountain ridge in the middle of a tropical forest in the Andes. Yale University has argued that the ancient city "belongs to humanity" and was properly declared a Cultural Patrimony of the World by UNESCO. Last week, Dodd visited Colombia, Ecuador and Peru, where he met with officials including Karp-Toledo's husband, former President Alejandro Toledo, and current President Alan Garcia. The senator said he is working to mediate the long-running dispute. “Yale is a remarkable institution whose countless contributions to our society extend far beyond academia alone," Dodd said. "For years, I have worked with Yale and Peru to seek a solution to this disagreement... I plan to work with both parties to resolve this dispute quickly, amicably, and return the artifacts to their rightful owners."
